Terms of Service

Please read these Terms carefully before using Hirrd. By creating an account or using the platform, you agree to be bound by them.

1. Acceptance of Terms

By registering for or using Hirrd, you confirm that you have read, understood, and agree to these Terms of Service and our Privacy Policy. If you do not agree, you must not use Hirrd.

If you are using Hirrd on behalf of a company, you represent that you have authority to bind that company to these Terms.

2. Platform Description & Limitations of Liability

Important: Hirrd is a neutral intermediary platform that connects jobseekers and employers. We are not a recruitment agency, employment agency, or employer.

Hirrd explicitly disclaims liability for:

  • The accuracy, completeness, or legality of any job posting created by an employer.
  • Hiring decisions, employment outcomes, or disputes arising between employers and jobseekers.
  • The suitability, skills, or honesty of any jobseeker or employer on the platform.
  • Failure to secure employment or fill a vacancy.
  • The conduct of any user on or off the platform after contact made through Hirrd.
  • Employment disputes, unfair dismissal claims, or discrimination complaints arising from hires made through Hirrd.
  • Any loss or damage arising from reliance on content posted by users.

Platform provided "as is": Hirrd makes no warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted availability. We do not guarantee any minimum uptime.

Limitation of liability: To the maximum extent permitted by Spanish law, Hirrd's total aggregate liability for any claim shall not exceed €100 (one hundred euros) or the amount paid by you to Hirrd in the 12 months preceding the claim, whichever is greater.

3. Eligibility & Accounts

To use Hirrd you must:

  • Be at least 16 years old. This is the age of digital consent in Spain under the LOPDGDD and the minimum working age for most roles under Spanish law (Estatuto de los Trabajadores, art. 6).
  • Have the legal capacity to enter into a binding contract.
  • Not have been previously suspended or banned from Hirrd.
  • Provide accurate information when registering.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at legal@hirrd.com if you suspect unauthorised access.

4. Employer Responsibilities & Liabilities

By posting jobs on Hirrd, employers agree that they:

  • Are solely responsible for the accuracy, legality, and completeness of all job postings.
  • Must comply with all applicable employment and labour laws, including Spain's Estatuto de los Trabajadores, the Ley Orgánica de Igualdad (Organic Law on Equality), and relevant EU Directives.
  • Must not post discriminatory listings. Job postings must not discriminate on the basis of sex, age, ethnic origin, religion, disability, sexual orientation, or any other characteristic protected under Spanish law (RD Legislativo 5/2000, Ley 15/2022) or EU law.
  • Are responsible for their hiring process, selection criteria, and final employment decisions. Hirrd has no involvement in or responsibility for these decisions.
  • Must use candidate data only for evaluating applications for the specific role advertised. Using candidate CVs or personal data for any other purpose (profiling, other roles without consent, sharing with third parties) is prohibited.
  • Must comply with GDPR as an independent data controller when processing candidate data received through Hirrd. This includes implementing appropriate security measures and deleting candidate data after the hiring process concludes.
  • Must delete CVs and application data when no longer needed for the hiring process, and in any case within a reasonable period after the vacancy is filled or withdrawn.
  • Are liable for any false, misleading, or unlawful job postings and for any harm suffered by jobseekers as a result.
False or misleading job postings, discriminatory listings, or misuse of candidate data may result in immediate account termination and may be reported to the AEPD (for data breaches) or relevant labour authorities.

5. Jobseeker Responsibilities

By applying for jobs through Hirrd, jobseekers agree that they:

  • Are responsible for the accuracy of their CVs, cover letters, and application information. Submitting false or misleading information may constitute fraud.
  • Consent to sharing their application (name, email, CV, cover letter) with the employer for the specific job they apply to. This is the core purpose of the platform.
  • Are responsible for their own employment decisions. Hirrd does not vouch for any employer and recommends independently verifying job offers before accepting employment.
  • Must not submit fraudulent applications for the purpose of collecting employer contact information or for any purpose other than genuine interest in the role.
  • Should independently negotiate employment terms with employers. Hirrd is not a party to any employment agreement and has no liability arising from it.

6. Prohibited Content & Conduct

The following is strictly prohibited on Hirrd:

  • Discriminatory job postings based on any protected characteristic under Spanish or EU law.
  • False, misleading, or fraudulent job listings, including posts where no genuine vacancy exists.
  • Multi-level marketing (MLM), pyramid schemes, or "commission only" schemes misrepresented as salaried positions.
  • Posting jobs on behalf of a company without authorisation.
  • Collecting candidate data for purposes other than genuine recruitment.
  • Automated scraping of the platform, creation of fake accounts, or using bots.
  • Uploading malware, spyware, or any harmful code.
  • Harassing, threatening, or defaming other users.
  • Any activity that violates applicable Spanish or EU law.

Hirrd reserves the right to remove any content that violates these prohibitions without prior notice.

7. Fraudulent and Misleading Job Postings

DSA Notice (EU Digital Services Act, Article 6): Hirrd operates as a passive hosting platform and neutral intermediary. We did not create and are not the author of employer job postings. Hirrd is not liable for third-party content hosted on the platform provided we act expeditiously to remove or disable access to manifestly illegal content upon becoming aware of it.

Fraudulent, misleading, and illegal job postings are a serious matter. This section sets out Hirrd's position and the responsibilities of all parties:

Employer liability:

  • Employers are solely and fully liable for the accuracy, legality, and authenticity of every job posting they create on Hirrd. This liability is unconditional and not limited by Hirrd's role as a hosting platform.
  • Posting fraudulent, misleading, or illegal job listings is a material breach of these Terms and may constitute a criminal offence under Spanish law, including but not limited to: estafa (fraud, Código Penal Art. 248–251), usurpación de identidad (identity fraud), and offences under Ley Orgánica 10/1995 del Código Penal relating to false pretences causing economic harm.
  • Employers who post false job listings for the purpose of collecting personal data, obtaining money from jobseekers, or any purpose other than genuine recruitment may be prosecuted under the above provisions and reported to the Policía Nacional, the Agencia Española de Protección de Datos (AEPD), and the relevant labour authorities.

Hirrd's position:

  • Hirrd does not verify employer identities, company registrations, or the factual accuracy of job postings before publication.
  • Hirrd reserves the right to remove any job posting at any time and for any reason, without prior notice, explanation, or liability.
  • Hirrd is not responsible for any loss, damage, financial harm, or personal harm suffered by any jobseeker as a result of a fraudulent or misleading job posting.
  • Upon receipt of a credible report of a fraudulent posting, Hirrd will act expeditiously to investigate and, where appropriate, remove the listing in accordance with our obligations under the EU Digital Services Act.
  • Hirrd may share user data with law enforcement authorities where required by law or where a credible threat of serious harm exists.

Jobseeker protections:

  • Jobseekers should exercise their own due diligence before sharing personal information, attending interviews, or accepting employment.
  • Never pay money to apply for a job. Legitimate employers do not charge application fees.
  • Never share bank details, passport numbers, or social security numbers before receiving a signed employment contract from a verified employer.

  • Suspicious listings can be reported using the "Report this job" button on any job listing page.

8. Intellectual Property

Platform: The Hirrd name, logo, design, and underlying code are owned by Hirrd and protected by Spanish and EU intellectual property law. You may not reproduce, distribute, or create derivative works without written permission.

User content: CVs, cover letters, job descriptions, and other content you upload remain your property (or your employer's property). By uploading content, you grant Hirrd a non-exclusive, royalty-free licence to store, display, and transmit that content solely to operate the platform.

No licence beyond platform use: This licence does not permit Hirrd to sell, license, or otherwise exploit your content for purposes other than running the Hirrd platform.

9. Data Processing

Each party processes personal data as an independent data controller for their own purposes:

  • Hirrd processes data to operate the platform as described in our Privacy Policy.
  • Employers process candidate data received through Hirrd as independent data controllers, and are solely responsible for their compliance with GDPR and other applicable data protection law.

Hirrd is not a data processor for employers. By receiving candidate applications, employers accept responsibility as data controllers for that data.

10. Account Termination

By you: You may delete your account at any time from Settings. Your personal data will be removed within 30 days in accordance with our Privacy Policy.

By Hirrd: We may suspend or permanently terminate your account if you:

  • Violate these Terms of Service.
  • Post false, discriminatory, or illegal content.
  • Misuse candidate data or breach GDPR obligations.
  • Engage in fraud, harassment, or abusive behaviour.
  • Are required to be removed by a court order or legal authority.

We will endeavour to notify you by email before termination unless doing so would be unlawful, prejudice an investigation, or is impractical due to the severity of the violation. Accounts terminated for serious violations will not be reinstated.

11. Governing Law & Dispute Resolution

Governing law: These Terms are governed by and construed in accordance with the laws of the Kingdom of Spain, without prejudice to any mandatory consumer protection rights you may have under the law of your country of residence.

Dispute resolution: In the event of a dispute, the parties agree to first attempt resolution in good faith through direct negotiation for a period of at least 30 days.

Jurisdiction: If a dispute cannot be resolved through negotiation, it shall be submitted to the exclusive jurisdiction of the courts of Spain. If you are a consumer resident in an EU member state, you may also bring proceedings before the courts of your member state of residence.

Online dispute resolution: EU residents may also use the European Commission's Online Dispute Resolution platform.

12. Platform Moderation

Hirrd operates a reactive moderation model. Job postings are published immediately without prior review and may be actioned after publication in response to user reports or Hirrd's own monitoring.

  • Right to remove content: Hirrd reserves the right to remove any job posting at any time without prior notice if it is found to violate these Terms, has been reported by users, or is deemed harmful to the platform community or individual users.
  • Right to suspend accounts: Hirrd may suspend or permanently terminate any account found to be in violation of these Terms of Service, applicable law, or Hirrd's community standards. Suspended users will be informed of the reason where legally permissible.
  • Moderation discretion: Moderation decisions are made at Hirrd's sole discretion. Hirrd is not obligated to review every piece of content and does not guarantee that all violating content will be identified or removed.
  • Appeals: Users may appeal moderation decisions by contacting support@hirrd.com within 30 days of the decision. Hirrd will review appeals and respond within 14 business days. Appeal outcomes are final.
  • Audit trail: Hirrd maintains an internal audit log of all moderation actions for accountability and legal compliance purposes. This log is not publicly accessible but may be disclosed to authorities when required by law.
  • User reporting: Users who believe a job listing violates these Terms may report it using the "Report this job" button on any listing page. Hirrd will review all reports and take appropriate action in a timely manner.
No pre-moderation: Hirrd does not review job postings before they go live. All users — especially jobseekers — should exercise their own due diligence. See our Job Search Safety Guide for guidance on identifying fraudulent listings.

13. Company Reviews

Hirrd provides a reviews system that allows jobseekers to rate and review companies they have applied to, interviewed with, or worked at.

Reviewer responsibilities:

  • Reviews must reflect genuine personal experience. You may only review a company if you have applied to, interviewed with, or worked at that company.
  • Reviewers are solely responsible for the content of their reviews. Hirrd does not verify the accuracy of reviews and is not liable for their content.
  • Reviews must not be defamatory, discriminatory, or otherwise unlawful. Reviews that constitute defamation or harassment may be removed and may expose the reviewer to legal liability.
  • Reviews must not include personal data of third parties (such as names of individual employees) without their consent.

Company responsibilities:

  • Companies may not incentivise, coerce, or pressure employees, applicants, or any other individuals to leave reviews on Hirrd, whether positive or negative.
  • Companies may not submit fraudulent or fake reviews of themselves or competitors. This constitutes a material breach of these Terms.

Hirrd's position:

  • Hirrd reserves the right to remove reviews that violate these Terms of Service, our community guidelines, or applicable law.
  • Hirrd does not verify the accuracy of reviews and makes no representations about their truthfulness.
  • Reviewer identities are partially anonymised (first name and last initial only) but are retained internally for moderation purposes.
  • Admin moderators may delete any review that violates these Terms.

14. Modifications

Hirrd reserves the right to modify these Terms. For material changes, we will:

  • Notify registered users by email at least 30 days before the effective date.
  • Update the version number and date at the top of this page.
  • Require acknowledgement of material changes on next login where appropriate.

Continued use of Hirrd after the effective date constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using Hirrd and may delete your account.
